- Speak to the DWP and understand why the benefit was cut.
- Send a GL24 Appeal form within 28 days from letter informing benefit withdrawal.
- Clearly set out reasons why benefit should be withdrawn.
- Contact GP for a discussion of condition and request copies of medical records
- Note the elements of the medical records which support the disability and which disprove the report of the Examining Medical Practitioner from ATOS.
- Copies of the records sent to HMCTS.
- Prepare a short report setting out;-
- How ability to walk or get around is affected by disability;
- What care is needed in the home;
- How the medical records support the claim;
- Why the Examining Medical Practitioner is incorrect;
- Why benefit should be returned;
- That benefit should be backdated to the date it was withdrawn;
- Attend appeal with a witness as a hearing has more chance of success that not attending.
- If you disagree with the decision consider what actually went wrong at the hearing (were you allowed to speak, did the panel consider everything you said, was your medical evidence very strong).
- Request full reasons for the refusal and consider a further appeal to change the decision and have another appeal arranged.
